Elite Green Transportation Terms of Service

These Terms of Service ("Terms") govern your use of Elite Green Transportation's services, including ride bookings, member and driver applications, and any related communications. By creating an account, booking a ride, or using EGT's services, you agree to these Terms. If you do not agree, do not use the service.

"EGT," "we," "our," or "us" refers to Elite Green Transportation, a California-licensed luxury electric livery service operating under California Public Utilities Commission TCP #0046494-A. "You," "rider," or "customer" refers to the individual booking or using the service.

1. Eligibility

EGT services are available only to individuals who are:

If you are booking on behalf of someone else (e.g., a parent booking a ride for an adult family member, or an executive assistant booking for an executive), you represent that the actual rider meets these eligibility requirements and that you are authorized to bind them to these Terms.

2. Account Registration

To book a ride or join the EGT 1K Loyalty Program you may be required to provide accurate account information including your full name, email address, and mobile phone number. You are responsible for keeping this information current. You are responsible for activity that occurs under your account, including by anyone you allow to access it. Notify us promptly at support@elitegreentransportation.com if you suspect unauthorized access.

3. Booking, Cancellation, and No-Show

Booking

Bookings may be made by phone, by SMS to dispatch, or through our member application once available. A booking is confirmed when EGT replies with a confirmation message that includes the assigned vehicle and date/time. Until you receive that confirmation, the booking is requested but not held.

Cancellation

TBD — Cancellation policy: Specific cancellation windows and any associated fees will be published here in a future revision. Pending publication, EGT's working policy is: cancellations made 4+ hours before scheduled pickup incur no charge; cancellations within 4 hours may be charged at EGT's discretion based on driver dispatch status. Customers will be notified of any charge before it is applied. Final policy will be added in a forthcoming revision.

No-show

TBD — No-show policy: EGT's working policy is that drivers will wait at the pickup point for up to 30 minutes (curbside or coordinated meeting point) before declaring a no-show. After 30 minutes, the booking is closed and a no-show charge equivalent to the booked rate may apply. Final policy will be added in a forthcoming revision.

Service area

EGT's San Diego County service area is the operating geography for local rides. EGT also performs scheduled long-distance routes (e.g., San Diego ↔ LAX) at published flat rates. EGT does not provide service into Mexico; customer drop-offs at the Cross Border Express (CBX) terminal in Otay Mesa are supported, with the customer walking across the border independently.

4. Payment Terms

Accepted payment methods: PayPal, Apple Pay, Google Pay. EGT does not store full credit card numbers; payment is processed by the third-party processor under their respective terms. Bookings made directly with dispatch may be settled at the conclusion of the ride or via invoice for established corporate accounts.

EGT's services are physical-service rides — they are not "digital goods" and are not subject to app-store billing requirements. Pricing is published as flat rates where applicable (Zone $50 / 1K Member $40, neighborhood-tiered SAN airport rates, fixed LAX rates) and is inclusive of gratuity. Additional fees disclosed at booking (e.g., extended wait time beyond the included buffer, requested vehicle upgrades) will be reflected on the receipt.

6. SMS Terms (TCPA & 10DLC Compliance)

SMS service provider: Twilio Inc. EGT uses Twilio's 10DLC carrier-registered messaging service to send and receive text messages.

Opt-in

You opt in to receiving text messages from EGT when you (a) create a member account and acknowledge SMS consent during signup, or (b) complete driver onboarding as a 1099 contractor and acknowledge SMS consent during that flow. Both consents are timestamped and retained.

Message frequency

Message frequency varies based on your booking activity. A typical single round-trip booking generates 3 to 8 messages, including booking confirmation, dispatch acknowledgment, driver-en-route, arrival notification, post-ride summary, and any operational follow-up. Customers with multiple active bookings will see proportionally more messages.

Opt-out

Reply STOP to any EGT text message to unsubscribe from all non-emergency messaging. We will send a single confirmation message confirming you have been removed from the list. Re-opt-in requires a new affirmative consent through the account or driver onboarding flow.

Carrier rates

Carrier message and data rates may apply. EGT does not charge for messaging; your wireless carrier may, depending on your plan.

Marketing messaging

EGT does not send marketing or promotional text messages to your number without explicit prior consent that is separate from the operational opt-in described above. Operational messages (booking confirmations, driver status, ride completion) are not "marketing" within the meaning of the Telephone Consumer Protection Act (TCPA), but if EGT later introduces optional marketing campaigns, an additional opt-in step will be presented.

7. EGT 1K Loyalty Program

The EGT 1K Loyalty Program rewards repeat riders. Enrollment is free, requires no app or portal, and is completed by phone with dispatch ("make me a 1K member"). Once enrolled, your standard rate drops from $50 to $40 immediately. You earn $100 in EGT credit for every $1,000 in cumulative spend, capped at six redemptions per calendar year ($599 maximum annual reward), redeemable as a flight, hotel, restaurant gift card, or other experience credit at your selection. Detailed program mechanics and any updates will be published at elitegreentransportation.com/loyalty/egt-1k-loyalty-program.html. A standalone Loyalty Terms page will be published in a future revision; until then, the published program description and these Terms govern.

8. Prohibited Conduct

You agree not to:

EGT may suspend or terminate access for violations, with or without notice depending on the severity of the violation.

9. Limitation of Liability

This limitation does not apply to claims that cannot be limited under California law, including but not limited to claims for personal injury arising from EGT's gross negligence or willful misconduct. EGT maintains commercial liability insurance of $1,500,000 per occurrence as required by California Public Utilities Commission TCP licensure.

10. Arbitration & Class Action Waiver

Notwithstanding the above, either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. Either party may seek injunctive relief in court for actual or threatened infringement of intellectual property rights or unauthorized access to the service.

You may opt out of this arbitration agreement by sending written notice to support@elitegreentransportation.com with the subject line "Arbitration Opt-Out" within 30 days of first agreeing to these Terms. The opt-out notice must include your full legal name, the email address associated with your account, and a clear statement that you are opting out of arbitration. Opting out does not affect any other provision of these Terms.

11. Governing Law & Venue

These Terms are governed by and construed under the laws of the State of California, without regard to its conflict of laws principles. For any claim not subject to arbitration under Section 10, the exclusive venue is the state and federal courts located in San Diego County, California, and you and EGT consent to personal jurisdiction in those courts.

12. Indemnification

You agree to defend, indemnify, and hold harmless EGT, its officers, employees, and agents from and against any third-party claims, damages, costs, or expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) your conduct during a ride that causes harm to the driver, the vehicle, or another person. This obligation survives termination of these Terms.

13. Severability & Entire Agreement

If any provision of these Terms is held unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy and any service-specific terms referenced herein (e.g., the forthcoming Loyalty Terms), constitute the entire agreement between you and EGT regarding the EGT service and supersede any prior or contemporaneous communications.

14. Changes to These Terms

We may update these Terms as our service evolves or to reflect changes in law. The "Effective" date at the top indicates the most recent revision. Material changes will be communicated by email to active members and drivers, and a notice will be posted on this page. Continued use of the service after the effective date of an update constitutes acceptance of the revised Terms.
